PRIVACY POLICY

We take your privacy very seriously; this Privacy Notice lays out what to expect in relation to the personal information about you that is collected, handled and processed by Armstrong Lloyd Ltd.

Armstrong Lloyd Ltd is a recruitment business that provides permanent recruitment services to its clients and work-seekers; that is to say we act as an agency as defined under the Employment Agencies Act 1973.

In order for Armstrong Lloyd Ltd to provide these services, we must collect and process personal data (which may include sensitive personal data on occasion). In doing so, we act as a Data Controller.

THE DATA, PURPOSE OF PROCESSING AND LEGAL BASIS

Armstrong Lloyd Ltd must have a legal basis for processing your personal data. We will collect your personal data (which may include sensitive personal data) for the purposes of providing you with work-finding services and keeping a record of our relationship with you.

You may give your personal details to us directly, such as via an application or via our website, or we may collect them from another source such as a jobs board or a publicly available source such as LinkedIn.

We will rely on your explicit consent to process your personal data. Information which may be gathered and processed for the purposes of finding you a suitable role is detailed below :

  • Your name

  • Your contact details (including your address, telephone numbers, email address)

  • Work history

  • Education and training (including certificates)

  • Remuneration (details of your current and desired remuneration package including benefits)

  • Job preferences (including location, willingness to relocate and transport)

  • Right to work in the UK (scanned copy of relevant documents i.e. passport or visa)

  • IP Address (only for the purposes of verification at the time you digitally consent to Armstrong Lloyd holding your information)

  • Pertinent details of our relationship with you (including records of opportunities presented, interviews, roles offered and accepted, start dates)

  • Copies of our correspondence history (including email and phone logs)

In the event you are offered an interview or a new job role, supplementary information may be requested in certain circumstances. This may be categorised as “Special” under the relevant data protection legislation. We will request your explicit consent separately in these instances.

  • Medical information (usually gathered for the purposes of protecting health and safety, to prevent discrimination on the ground of disability, or to support our clients who are “Disability Confident Employers”)

  • References

  • Unspent criminal convictions / outcome of criminal record check

  • Information Disclosure

We will only make your personal information visible to our clients in the event you are put forward for an opportunity, or where required for the fulfilment and ongoing management of a contract where we have placed you. We will notify you prior to submitting your personal information to any of our clients.

We may also disclose your personal information to third parties:

  • responsible for running our business processes:

  • our emails, database and data storage are hosted in the cloud. Whilst these cloud providers would not typically have direct access to your information, storage is considered processing under the relevant data protection legislation.

  • services who support our application management processes.

  • if we sell the business and its associated assets; in which case we may disclose your personal data to the prospective buyer of such business or assets.

  • if we are under a duty to disclose or share your personal data in order to comply with any legal obligation, or in order to enforce or apply our terms of use which includes exchanging information with other companies and organisations for the purposes of fraud protection.

OVERSEAS TRANSFERS

Armstrong Lloyd Ltd works with international clients based in countries outside of the European Economic Area (“EEA”). We may transfer only the information you provide to us to these countries for the purposes of providing you with work-finding services. We will take steps to ensure adequate protections are in place to ensure the security of your information. The EEA comprises the EU member states plus Norway, Iceland and Liechtenstein.

WHAT WE DO WITH YOUR DATA

Your data is stored on our cloud-based database.

We acquire and process your data in order to:

  • place you to the most suitable position according to your background and experience

  • contact you to discuss other opportunities that may meet your requirements

  • ensure the fulfilment and ongoing management of a contract where we have placed you.

  • for the purpose of identification

  • comply with our legal and regulatory obligations

  • keep you up to date via email with job hunting advice, market commentary, white papers and other marketing communications relevant to your job search in the marketing sector (where you have explicitly consented to receive these communications)

  • use data analytics to improve our website, services, marketing, customer relationships and experiences

DATA RETENTION

We will hold your data for no longer than 2 years before seeking your consent for us to continue to hold your data.

If we have presented you for a role to one of our clients, you have been interviewed or placed, the Conduct of Employment Agencies and Employment Business Regulations 2003 require us to keep work-seeker records for at least one year after the date on which we last provided you with work finding services.

YOUR RIGHTS

Under data protection legislation (as comes into effect under GDPR on 25th May 18), you have the following rights:

  • The right to be informed about your personal data Armstrong Lloyd Ltd holds and processes.

  • The right of access to your personal data – you may ask for a copy from us at any time free of charge.

  • The right to rectification of your personal data.

  • The right to restrict processing of your personal data.

  • The right to object to the processing of your personal data that was based on a public or legitimate interest.

  • The right not to be subjected to automated decision making and profiling.

  • The right to withdraw consent at any time.

  • The right to erasure of your data.

If we have introduced you to one of our clients for a new role, you have been interviewed or placed within 12 months of your request, we will be unable to erase your data. In this instance, the current data protection legislation is superseded by the Conduct of Employment Agencies and Employment Business Regulations 2003 which require us to keep records for one year after we last provided you with our services.

After this timeframe has elapsed, we will be happy to comply with your request. You may in the meantime request your record be deemed “Inactive” in order that we do not approach you with any other roles in the interim. DATA SECURITY

The Company takes every precaution to protect our users’ information. We have taken appropriate security measures to prevent the loss, unauthorised use, access, alteration or disclosure of your personal data.

Only employees who need the information to perform a specific job (for example, consultants, our accounts clerk or a marketing assistant) are granted access to your information.

The Company uses all reasonable efforts to safeguard your personal information. However, you should be aware that the use of email/ the Internet is not entirely secure and for this reason the Company cannot guarantee the security or integrity of any personal information which is transferred from you or to you via email/ the Internet.

If you share a device with others we recommend that you do not select the “remember my details” function when that option is offered.

If you believe that your data protection rights have not been adhered to, you also have the right to raise concerns with the Information Commissioner’s Office at https://ico.org.uk/concerns/ or 0303 123 1113.
